Welcome to Kingston Storage. Please read these Terms and Conditions carefully before using our storage services. By accessing or using our facilities, you agree to be bound by these terms.
1. Introduction
These Terms and Conditions govern your use of the storage units provided by Kingston Storage. Our goal is to ensure a secure and satisfactory experience for all our customers.
2. Definitions
- Customer: Any individual or entity that rents a storage unit from Kingston Storage.
- Storage Unit: A designated area rented out for the purpose of storing personal or business items.
- Agreement: The contractual terms between Kingston Storage and the Customer.
3. Eligibility
Customers must be at least 18 years old to enter into a rental agreement. Identification such as a valid driver's license or government-issued ID is required at the time of signing up.
4. Reservations and Payments
All reservations are subject to availability. A refundable deposit may be required prior to accessing the storage unit. Payments are due monthly in advance, and can be made via various payment methods, including credit card, debit card, or automatic bank withdrawals.
4.1 Late Payments
If a payment is not received by the due date, a late fee will be applied. Continued non-payment may result in the termination of your rental agreement and possible legal action to recover owed amounts.
5. Use of Storage Units
Storage units are intended for the storage of personal items. The following activities are prohibited:
- Hazardous Materials: Storing flammable, explosive, or toxic substances is strictly forbidden.
- Illegal Items: Any items that are illegal to possess are prohibited.
- Commercial Activities: Using the storage unit as a place of business is not allowed.
6. Customer Responsibilities
Customers are responsible for the security of their belongings. While Kingston Storage employs various security measures, we do not accept liability for lost or damaged items unless caused by our negligence.
6.1 Access to Storage Units
Access to storage facilities is restricted to designated hours. Customers must use their personal access codes or keys to enter the premises. It is the customer's responsibility to keep their access credentials secure.
7. Liability and Insurance
Kingston Storage is not liable for any loss or damage to stored items, except in cases of proven negligence on our part. We recommend that customers obtain their own insurance to cover the value of their stored possessions.
8. Termination of Agreement
Either party may terminate the rental agreement with written notice. Upon termination, customers must remove all items from the storage unit by the specified date. Failure to do so may result in additional fees or disposal of the remaining items.
8.1 Early Termination
Customers wishing to terminate their agreement before the end of the rental period may be subject to an early termination fee as outlined in their contract.
9. Privacy Policy
Your privacy is important to us. We collect and use personal information solely for the purpose of managing your storage account. We do not share your information with third parties except as required by law.
10. Amendments to Terms
Kingston Storage reserves the right to modify these Terms and Conditions at any time. Customers will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.
11. Governing Law
These Terms and Conditions are governed by the laws of the jurisdiction in which Kingston Storage operates. Any disputes arising from these terms will be resolved in the appropriate legal venues.
12. Dispute Resolution
In the event of a dispute, both parties agree to seek resolution through mediation before pursuing legal action. Mediation provides a confidential and cost-effective way to settle disagreements.
13. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions will continue to be in full effect.
14. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Customer and Kingston Storage regarding the use of our storage services, superseding all prior agreements or understandings.
15. Indemnification
Customers agree to indemnify and hold harmless Kingston Storage from any claims, damages, or liabilities arising from their use of the storage facilities, except where caused by our own negligence.
16. Force Majeure
Kingston Storage is not liable for any failure to perform its obligations due to events beyond its reasonable control, such as natural disasters, wars, or pandemics.
17. Notices
Any notices required under these Terms and Conditions will be provided in writing and delivered to the Customer's address on file.
18. Assignment
Customers may not assign or transfer their rental agreement to another party without the prior written consent of Kingston Storage.
19. Waiver
The failure of Kingston Storage to enforce any part of these Terms and Conditions does not constitute a waiver of the right to enforce those terms in the future.
